Discuss the impact EU membership has had on the doctrine of Parliamentary sovereignty.


  • When entering into the European Union, Member States transferred some of their sovereign powers and rights to the EU institutions, thus giving those EU institutions the ability to create law which binds both individuals and Member States.
  • Section 18 of the European Union Act 2011 purports to put an end to this debate, declaring that EU law forms part of the UK only by virtue of an Act of Parliament. In other words, Parliament is still sovereign and could still take back its law making powers from the EU if it wished to do so.
