Young v Kent County Council [2005] EWHC 1342

Facts:

  • C fell through a skylight whilst on the roof of a school building which was accessed by pipework on the exterior of the building.
  • C argued that the council was liable under the 1984 Act.

 Ratio:

  • Council was liable to 50%.
  • School was negligent in not carrying out a risk assessment on the area and not fencing the area off.

Judicial review allows people with a sufficient interest to ask a judge to review the lawfulness of a decision of a public body. The claimant must have the right to claim by having enough interest in the matter. There are exclusion of judicial review by the Parliament. For people that are affected by the decision are able to ask for review, and the government will be affected only if they have made an unlawful decision.
